A well-known objection to prioritarianism, famously levelled by Mike Otsuka and Alex Voorhoeve, is that it wrongly ignores the unity of the individual in treating intra-personal cases like inter-personal cases. In this paper we accept that there should be a moral shift between these cases, but argue that this is because autonomy is a relevant consideration in intra-personal but not inter-personal cases, and one to which pluralist prioritarians ought to attend. To avoid this response, Otsuka and Voorhoeve must assume we (...) know nothing about the subjective information of the person being chosen for. But we show that this commits them to two controversial assumptions: that welfare consists in an objective list of goods, and – if one accepts an unorthodox but plausible account of the relationship between risk aversion and rationality – that there is only a narrow range of rational risk aversions. Only prioritarians who accept both these assumptions are on the hook of Otsuka and Voorhoeve’s objection; for all others, the examples have insufficient information, and so lose their sting. The adversarial legal system is traditionally praised for its normative appeal: it protects individual rights; ensures an equal, impartial, and consistent application of the law; and, most importantly, its competitive structure facilitates the discovery of truth – both in terms of the facts, and in terms of the correct interpretation of the law. At the same time, legal representation is allocated as a commodity, bought and sold in the market: the more one pays, the better legal representation one gets. In (...) this article, I argue that the integration of a market in legal representation with the adversarial system undercuts the very normative justifications on which the system is based. Furthermore, I argue that there are two implicit conditions, which are currently unmet, but are required for the standard justifications to hold: that there is (equal opportunity for) equality of legal representation between parties, and that each party has (equal opportunity for) a sufficient level of legal representation. I, therefore, outline an ideal proposal for reform that would satisfy these conditions. (shrink)

I offer a novel distinction between two concepts of competition. The first, parallel competition, is designed to create separate pathways for each competitor wherein they can maximize their performance. The second, friction competition, is designed to facilitate a clash between competitors. Each concept is utilized as an institutional mechanism to generate social benefits. In parallel competition, the social benefit is the result of the aggregation of the independent efforts of each competitor. In friction competition, it emerges from the clash between (...) competitors. I argue that this distinction carries significant normative implications concerning debates over equality, freedom, and democratic institutional design. (shrink)

While moral arguments for limiting market expansionism proliferate, a fundamental question has been left unanswered: the moral limits of what, exactly? Moral Limits of Markets (MLM) theorists tend to employ different terms – markets, putting a price tag, buying and selling – interchangeably and inconsistently to describe the phenomenon they are troubled by. I clarify this ambiguity by offering a novel taxonomy of different dimensions of exchange I identify as the sources of the normative concerns of most MLM arguments: Alienation, (...) Commodification, Marketization, Privatization. This taxonomy allows us to better understand why and what about ‘markets’ should be limited. (shrink)

Despite being largely overlooked in the literature, Israel provides a rare example of what a full decade of twenty-first century populism in power looks like. Based on an examination of rhetoric and policymaking between 2009 and 2019, this article brings the writing on the subject up to date and highlights the unique traits of Israeli populism. In so doing it establishes that Israeli populism has been mainstreamed to a remarkable extent and currently encompasses almost all right-wing parties in the country’s (...) legislature. Moreover, it shows that the Israeli case embodies a variety of populism which has yet to be acknowledged in the literature – neither economic nor cultural in character, but rather based on national security issues. The concept of ‘security-driven populism’, introduced here, could prove useful to researchers studying other populist regimes that do not fit neatly into the ‘culture versus economy’ debate, which has dominated the field for years. Thomas Jefferson’s famous proposal; whereby a state’s constitution should be re-enacted every 19 years by a majority vote; purports to solve the intergenerational problem caused by perpetual constitutions: namely that laws which were enacted by people who are already dead bind living citizens without their consent. I argue that the model fails to fulfil its own normative consent-based aspirations. This is because it produces two groups of people who will end up living under laws to which they did not give (...) their consent: citizens who reach the voting age after the re-enactment process; citizens who did not assent to being obliged by the majority vote’s results. I reject possible responses to my argument by showing that they result in making the model either impractical or redundant. The remainder of the paper discusses whether implementing the model would enhance the consent-based legitimacy of the modern state. (shrink)

The rich evade conviction more often in criminal trials than the poor. They also win more often in civil cases against the poor. Given that money buys better lawyers and better lawyers are instrumental in winning in adversarial trials, the rich have a structural advantage in laissez-faire trial systems. Such inequality is concerning. In a landmark article, Alan Wertheimer argues that we should level down legal resources in civil cases on the basis that doing so increases the adversarial system’s accuracy—that (...) is, its chance of reaching correct decisions. In a more recent article, along similar lines, Shai Agmon also advocates that, given some constraints of adequacy, legal resources should be leveled down in both civil and criminal cases. This article aims to show that such arguments fail because leveling down legal resources could decrease a trial system’s accuracy, making it worse by Wertheimer’s or Agmon’s own criteria. (shrink)

Central to contemporary cognitive science is the notion that mental processes involve computations defined over internal representations. This view stands in sharp contrast to the to visual perception and cognition, whose most prominent proponent has been J.J. Gibson. In the direct theory, perception does not involve computations of any sort; it is the result of the direct pickup of available information. The publication of Gibson's recent book (Gibson 1979) offers an opportunity to examine his approach, and, more generally, to contrast (...) the theory of direct perception with the computational/representational view. In the first part of the present article (Sections 2direct perceptioncase study”: the problem of perceiving the three-dimensional shape of moving objects is examined. This problem, which has been extensively studied within the immediate perception framework, serves to illustrate some of the inherent shortcomings of that approach. Finally, in Section 5, an attempt is made to place the theory of direct perception in perspective by embedding it in a more comprehensive framework. (shrink)

It is proposed to conceive of representation as an emergent phenomenon that is supervenient on patterns of activity of coarsely tuned and highly redundant feature detectors. The computational underpinnings of the outlined concept of representation are (1) the properties of collections of overlapping graded receptive fields, as in the biological perceptual systems that exhibit hyperacuity-level performance, and (2) the sufficiency of a set of proximal distances between stimulus representations for the recovery of the corresponding distal contrasts between stimuli, as in (...) multidimensional scaling. The present preliminary study appears to indicate that this concept of representation is computationally viable, and is compatible with psychological and neurobiological data. (shrink)

In a recent article, Azzouni has argued in favor of a version of formalism according to which ordinary mathematical proofs indicate mechanically checkable derivations. This is taken to account for the quasi-universal agreement among mathematicians on the validity of their proofs. Here, the author subjects these claims to a critical examination, recalls the technical details about formalization and mechanical checking of proofs, and illustrates the main argument with aanalysis of examples. In the author's view, much of mathematical reasoning presents genuine (...) meaning-dependent mathematical characteristics that cannot be captured by formal calculi. ‘…there is a conflict between mathematical practice and the formalist doctrine.’ [Kreisel, 1969, p. 39]. The problem of representing the spatial structure of images, which arises in visual object processing, is commonly described using terminology borrowed from propositional theories of cognition, notably, the concept of compositionality. The classical propositional stance mandates representations composed of symbols, which stand for atomic or composite entities and enter into arbitrarily nested relationships. We argue that the main desiderata of a representational system—productivity and systematicity—can (indeed, for a number of reasons, should) be achieved without recourse to the classical, proposition‐like compositionality. We show how this can be done, by describing a systematic and productive model of the representation of visual structure, which relies on static rather than dynamic binding and uses coarsely coded rather than atomic shape primitives. This study evaluated the potential contribution of extrageniculate visual pathways to oculomotor orienting reflexes in hemianopic patients. It tested whether extrageniculate pathways mediate inhibition of return —a phenomenon characterized by slowed target detections at recently stimulated locations . Because hemianopic subjects cannot overtly respond to stimuli presented within their hemianopic field, we utilized a spatial cueing paradigm that capitalized on the fact that IOR operates in spatiotopic coordinates. Subjects moved their eyes so that a cue and a target presented at (...) the same spatial location were imaged successively onto blind and seeing portions of their retinas. One hemianopic patient showed a similar IOR effect from cues presented within both the seeing and the hemianopic fields. With a second hemianopic patient, only presentations of the cue to the subject's seeing field produced IOR. The explanation for this discrepancy is not evident. These observations highlight both the potential value and the pitfalls inherent in using “blindsight” as a window into human consciousness. (shrink)

For their testimonial value, Jean Améry's writings are obligatory reading for anyone interested in studies of the Holocaust. But Améry can and must also be read as philosophy, argues Roy Ben-Shai. In Améry's work, the combination of the testimonial and the philosophical constitutes a "twilight", a revolt against the separation of pathos (experience) and logos (the intellect), and a call for the insertion of the victim into philosophical discourse.

What is critique? How is it used and abused? At a moment when popular discourse is saturated with voices confronting each other about not being critical enough, while academic discourses proclaim to have moved past critique, this provocative book reawakens the foundational question of what 'critique' is in the first place. Roy Ben-Shai inspects critique as an orientation of critical thinking, probing its structures and assumptions, its limits and its risks, its history and its possibilities. The book is a (...) journey through a landscape of ideas, images, and texts from diverse sources - theological, psychological, etymological, and artistic, but mainly across the history of philosophy, from Plato and Saint Augustine, through Kant and Hegel, Marx and Heidegger, up to contemporary critical theory. Along the way, Ben-Shai invites the reader to examine their own orientation of thought, even at the moment of reading the book; to question popular discourse; and to revisit the philosophical canon, revealing affinities among often antagonistic traditions, such as Catholicism and Marxism. Abstract. Darwinism has attracted proportionately less attention from Jewish thinkers than from Christian thinkers. One significant reason for the disparity is that the theodicies created by Jews to contend with the catastrophes which punctuated Jewish history are equally suited to address the massive extinctions which characterize natural history. Theologies of divine hiddenness, restraint, and radical immanence, coming together in the sixteenth-century mystical cosmogony of Isaac Luria, have been rehabilitated and reworked by modern Jewish thinkers in the post-Darwin era.

We examined the role of fitness, commonly assumed without proof to be conferred by the mastery of language, in shaping the dynamics of language evolution. To that end, we introduced island migration (a concept borrowed from population genetics) into the shared lexicon model of communication (Nowak et al., 1999). The effect of fitness linear in language coherence was compared to a control condition of neutral drift. We found that in the neutral condition (no coherence-dependent fitness) even a small migration rate (...) – less than 1% – suffices for one language to become dominant, albeit after a long time. In comparison, when fitness-based selection is introduced, the subpopulations stabilize quite rapidly to form several distinct languages. Our findings support the notion that language confers increased fitness. The possibility that a shared language evolved as a result of neutral drift appears less likely, unless migration rates over evolutionary times were extremely small. (shrink)

Supposing the symbol system postulated by Barsalou is perceptual through and through -- what then? The target article outlines an intriguing and exciting theory of cognition in which (1) wellspecified, event- or object-linked percepts assume the role traditionally allotted to abstract and arbitrary symbols, and (2) perceptual simulation is substituted for processes traditionally believed to require symbol manipulation, such as deductive reasoning. We take a more extreme stance on the role of perception (in particular, vision) in shaping cognition, and propose, (...) in addition to Barsalou's postulates, that (3) spatial frames, endowed with a perceptual structure not unlike that of the retinotopic space, pervade all sensory modalities and are used to support compositionality. Idealized mo dels of receptive elds (RFs) can be used as building blocks for the creation of p owerful distributed computation systems. The present rep ort concentrates on inv estigating the utility of collections of RFs in representing 3D objects under changing viewing conditions. The main requirement in this task is that the pattern of activity of RFs vary as little as p ossible when the object and the camera move relative to each other. I propose a method for representing (...) objects by RF activities, based on the observation that, in the case of rotation around a xed axis, dierences of activities of RFs that are prop erly situated with resp ect to that axis remain inv ariant. Results of computational exp eriments suggest that a representation scheme based on this algorithm for the choice of stable pairs of RFs would p erform consistently b etter than a scheme inv olving random sets of RFs. The proposed scheme may be useful under object or camera rotation, b oth for ideal Lam b ertian objects, and for real-world objects such as human faces. (shrink)

Its point of departure is Kant's "Antinomy of practical reason", where Kant confronts between the metaphysical and empirical aspects of human existence. Kant's discussion of this issue continues in "Critique of the aesthetical judgment", where he considers the aesthetic experience as a synthesis between these two aspects of human existence. At the end, the paper compares between Kant's view and Kierkegaard's idea of the different spheres of human existence for (...) clarifying Kant's existential view, which is implied in his texts but does not appear as an explicit thesis in his writings. The recent bioethical literature addresses numerous new problems posed by advancing medical technology and demonstrates an erosion of standards rooted in religion and long widely accepted as almost axiomatic. In the deep soul-searching that pervades the publications on bioethics, several disturbing and dangerous trends neglect some basic lessons of philosophy, logic, and history. The bioethics (...) discourse on medical aid in dying emphasizes similarity over previously recognized important distinguishing features. For example, it overplays a likeness between assistance in dying and the withdrawal of life-saving technology. In many bioethics’ topics, arguments based on a logical continuum are used to question the lines demarcating important moral differences. l. The Line Between Ethical and Not: Logic Based on Continuum Careful case selection, often either end of a continuum, allows the tearing down or ridiculing of many rules and codes across most professions and fields of interest. This situation holds true for traffic laws as well as medical ethics guidelines. It is relatively simple for those who desire to attack a particular viewpoint by selecting a case that makes that position seem untenable. In the ethics realm, good and bad medicine exist at opposite ends of an ethical continuum, with many practices lying in between. For example, much of medical ethics exists between the Nazi criminal physicians and the most sainted nurse or physician. A gradual progression occurred over less than two decades from a utilitarian position that supported limited euthanasia for those with certain mental illnesses to genocide. German society embraced a utilitarian ethic in which the value of human life no longer was intrinsic but instrumental.[1] Many morally significant points on a continuum were then ignored as the misguided utilitarian policy rampantly continued. A point in the continuum to distinguish between ethically justifiable and that which is not can be difficult to identify compared to the two extremes. This continuum is not unique to ethics but can be applied to almost any other aspect of human life and endeavor. Between a severely ill schizophrenic person and a superbly well-adjusted individual, there is a continuum of mental and psychological function. The existence of a continuum should not paralyze thinking and prevent us from drawing lines and identifying moral differences based on objective criteria as well as moral philosophy. Yet, by focusing on a continuum, many bioethicists use logic to disregard dividing lines between an "ethical" and an "unethical" act. Unfortunately, sometimes bioethicists draw revolutionary conclusions that would change the scope of medical practices which is accepted as ethical. There are many examples of similar shifts on the continuum. Many authors argue for the ethical permissibility of abortion by pointing out that the human fetus is no different in various characteristics, one arguing it is as like an ape or chick as it is like a person,[2] and does not achieve unique human and individual characteristics until well into the first year of life.[3] While human fetuses arguably do not have certain distinctive qualities of personhood, most people shy away from the logical next conclusion: permitting infanticide. For example, Joshua Lederberg condemns infanticide, in the face of biological illogic, because of our emotional commitment to infants, to me, a relatively weak explanation. Sir Francis Crick suggests we might consider birth at two days of life in order to decide whether an infant is a "suitable" member of society.[4] Giublini and Minerva suggest that infanticide should be permissible since late pregnancy abortions are permissible, arguing there is no significant difference between a fetus just before birth and an infant just after birth.[5] Clearly the continuum approach would allow for subjective arguments in favor of later infanticide at other points many days post-birth. Years ago, with a cynical tone, I mentioned infanticide as a further step on the continuum beyond abortion, and I was rightly shouted down as being deliberately provocative to assert the logic would ever stretch so far. While it is not an accepted mainstream position, the movement in academic settings from widespread condemnation to limited possible acceptance of infanticide has taken place in an incredibly short time. Public opinion and medical opinion in these areas have shifted dramatically in a short time. In another area, from a biological and chemical point of view, there is a continuum from man down to a single carbon atom. Yet, it would not seem logical to ignore the emotional differences, the meaning of personhood, or the moral distinction between killing an insect and killing a person. ll. A False Continuum: Medical Aid in Dying I assert that there has been an erosion of ethical guidelines in recent years attributable to using continuums to camouflage important distinctions. James Rachels’ work on active and passive euthanasia, which contends that the two are ethically identical, exemplifies that logic.[6] He illustrates this thesis, using a continuum to compare different scenarios with like consequences as morally equivalent, by comparing the deliberate drowning of a child with a deliberate failure to rescue a drowning child when easily able to do so. The author's comparison proposes that since much of the medical profession has already made peace with withholding treatment in order to hasten death, consistency inexorably demands that we permit active euthanasia as well.[7] When permission for active euthanasia was first introduced, it was limited exclusively to patients suffering severely from an intractable, incurable, and irreversible disease. These guidelines have been continuously eroded. There is now a substantial serious consideration for permitting active euthanasia of healthy elderly individuals who feel that they have completed their lives and are "tired of living."[8] There are many moral and factual differences along the ethical continuum. In human life, there is a difference between a live baby and a fetus, between a viable fetus and one that is not, between a fetus and a zygote, and between a zygote and a sperm cell. Similarly, there is a difference between pulling a trigger to kill someone and not interfering in preventing his death, which is reprehensible though both may be. There is a difference between not resuscitating an 80-year-old man with cancer when his heart stops and injecting him with a fatal dose of potassium chloride. I argue that an overt act of taking life repels civilized human beings is to be commended and encouraged as the reverence for human life or even for just a moment of human life is one of the great contributions of our civilization. CONCLUSION As an orthodox Jew, I feel that divinely inspired guidelines that have stood the test of centuries shape my beliefs, and such guidelines contradict medical aid in dying. I cannot speak to the viewpoint of those who do not access religion in defining their moral stance, nor do I implicate them in the current bioethics' trends, as I am not aware of the personal role of religion in the lives of most such authors. While many nonreligious people have a firm philosophical grounding and oppose medical aid in dying, I suggest that in the absence of any religious or other absolute standards, developing logically defensible ethical guidelines may be challenging. At the least, religion may play a role in defining the points on the continuums that are ethically meaningful and refuting the trending beliefs that if the endpoint is the same, allowing different methods of arriving at that end are somehow ethically equal. The continuum of ways death may result does not negate analysis of whether death is brought about in ways that recognize the importance of life. The German philosopher Hans Jonas said, "It is a question whether without restoring the category of the sacred, the category most thoroughly destroyed by the scientific enlightenment, we can have an ethics able to cope with the extreme powers that we possess today and constantly increase and are compelled to use."[9] While countries vary on the role of religion in policy, with many emphasizing freedoms of religion, a recent position paper released by a group of Jewish, Christian, and Moslem leaders suggested the need for agreement on the unique sanctity of human life.[10] I would recommend that such a document serve as an example of consensus on critical foundational bioethical guidelines for democratic secular societies. - [1] Alexander L Medical science under dictatorship. At the end of the fifteenth century, the Castilian-Aragonian Eli Habilio wrote what is now the only extant, complete, and original Hebrew commentary on the entire Metaphysics of Aristotle. This commentary is short, about 15 folio pages long, and consists almost entirely of quotations from Averroes’ Middle Commentary on Aristotle’s Metaphysics in the early fourteenth-century translation of Qalonimos ben Qalonimos. Yet Habilio elsewhere expresses only disdain for Averroes and hopes that Jews will turn away from Averroes to read Scotus’ metaphysical (...) works instead. The author’s claim is that Habilio’s Commentary is intended to supplement his translation of Antonius Andreas’ questions on the Metaphysics and provide a Hebrew summary of the most read Hebrew version of the Metaphysics that would choose its words in such a way as not to contradict Scotus and in some cases even to encourage its readers to seek out a Scotist approach. The Kuzari: In Defense of the Despised Faith is the first new translation into English of The Kuzari since 1905, annotated and explained based on the classic commentaries. Written by Rabbi Yehuda HaLevi of Spain over a period of twenty years and completed in 1140, The Kuzari has enthralled generations of Jews and non-Jews alike with its clear-cut presentation on Judaism, and its polemics against Greek philosophy, Christianity, Islam, and Karaism.

Although they approach the topic from different perspectives, they both seem to find my account of the evolution of monoamine theories into neuroplasticity theories to be compelling. This paper examines the claim that the two final articles of Rav Kook’s book Ikvei Hatzon were written as a response to a lecture given by Hermann Cohen. It first reviews Cohen’s lecture showing that, regarding the concept of God, Cohen argues for the compatibility of Judaism and Kantianism in denying the dogmatic-mythological preoccupation with the existence of God in favor of understanding God as the basis of morality. Second, it analyzes Kook’s articles, demonstrating that he accepts the compatibility of (...) Judaism and Kantianism together with the denial of the dogmatic relation to God as a substance. Nevertheless, Kook is not satisfied with the critical view that denies the dogmatic relation to the substance altogether, since it formulates a merely negative relationship with God. Instead, he develops his concept of the Divine Ideals, which synthesizes the dogmatic preoccupation with substantiality and the critical denial of it. The Divine Ideals are the moral progression of man, through which man gradually becomes identical to God. Within the Divine Ideals, dogmatism becomes an emotional striving to be identical with God as a substance, while criticism is the intellectual negation of the possibility of such identity, which ensures that the process will continue indefinitely.
